RUSSELL COUNTY, Va. -

A state agency is set to discuss a dispute between Virginia landowners and two gas companies over unpaid royalties that has become an issue in the race for governor.

The Virginia Oil and Gas Board will meet in Russell County on Tuesday.

In an opinion in June, U.S. Magistrate Judge Pamela Meade Sargent accused an assistant attorney general of assisting one of the energy companies involved. She recommended that the landowners' claims against EQT Production Co. and CNX be certified as a class action with tens of millions of royalty payments at stake.

Attorney General Ken Cuccinelli - the Republican nominee - has received more than $100,000 from Consol Energy, of which CNX is a subsidiary.

Groups say they'll protest outside the meeting and in front of Cuccinelli's Richmond office.

That meeting is scheduled for 9:00am Tuesday at the Russell County Government Center in Lebanon, Virginia.
