GREENEVILLE, Tenn. -

The jury has returned from deliberation and says they are deadlocked on the assault charge against Tennessee House of Representative David Hawk.

They came back into the courtroom and delivered the verdict around 2 p.m. on Thursday.

We've learned the jury did return a guilty verdict on the reckless endangerment charge.

Hawk says the fight isn't over for him. "As always throughout the process, I have maintained my innocence. I'm looking forward to weighing our options going forward and we plan to appeal this decision," he said.

The state says they plan on dropping the assault charge.

Hawk's attorneys say they will ask for judicial diversion, meaning once Hawk meets sentencing requirements the reckless endangerment charge could be taken off his record.

He'll be back in a Greene County courtroom October 31 for sentencing.
